Exclude flagged and banned members from bulk mail

Are banned or flagged spam users excluded from the bulk mail option? I don't see an option to confirm this.

Also, I tried to download the list of members, but I don't see an option to exclude banned or flagged spam users. I confirmed that they show up in the downloaded list. I would appreciate help with that, too.
