I'm not a lawyer, I'm not about to take advice on a forum, nor agree or disagree with you, but simply state that the hassle that was caused by the ban message being in place led my forum to remove the label entirely. It caused a considerable amount of grief and the former member had no intention of letting up.
I'd come back to my first point though, there really is no need to label a person banned. If members ask, tell them it's none of their business. It's quite simple when moderation decisions are elevated above membership scrutiny.

Most of them are too stupid to even think of using a different IP or even a vastly different name for their email or display name so it sometimes helps to have history to check.

I prefer that people not be able to see it. It's a privacy thing. People don't need to know when others are banned. I remove the content that got the person banned in the first place so seeing it there is just a nasty black mark that I don't think is necessary.

Too much unnecessary work, would also need to promote moderators to administrators in order to do that

I noticed there is nothing that indicates that the member is banned anymore, you'll have to visit the profile to see it. And that's only when you are Moderator or Administrator.

I think there should be something that indicates the member is banned, on 3.4 we had a own group for banned members which did the job.

Is there a way to change the "Last Visited" to Private? I think that would be a good addition and is needed by many people. It can be optional too.

if anonymous visitor then the ' last visit' on profile and popup cards could work better if it displays 'private' rather than the last time the member logged in non-anonymously
as the last visited on profile currently can show members last visit as say 1 june 2014  yet can show posts/comments from yesterday
which can be confusing to all as it is to all purposes displaying false information!
also in acp the last visited also only gives the last visited when not anonymous - that can be a big difference if 'cleaning up' accounts

Bringing this question back up.  In v4.1.11 how do I make a member's profile visible only to registered users (or better yet, a specific member group)?
I cannot find the option for Profiles using this....

I'll be updating my dev system to 4.1.7 today to run some tests, hopefully that's the underlying cause.

And each time I enable the plugin, the Status Bar disappears!

and when I try to open the block it says:
